By accessing or using GrailVault ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We reserve the right to update these terms at any time, and your continued use of GrailVault constitutes acceptance of any changes.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your account information up to date. You agree to notify us immediately of any unauthorized use of your account.

3. Marketplace Transactions

GrailVault is a platform that connects buyers and sellers of trading cards, collectibles, and related items. GrailVault is not a party to transactions between buyers and sellers. Buyers and sellers are solely responsible for the terms of their transactions, including item condition, pricing, shipping, and returns. GrailVault charges service fees on completed transactions as outlined on the Platform. All fees are non-refundable unless otherwise stated.

4. Listing Requirements

Sellers must provide accurate and truthful descriptions of all listed items. All items must be authentic. Grading claims must be supported by certification from recognized grading companies (e.g., PSA, BGS, CGC) where applicable. GrailVault reserves the right to remove any listing that violates these requirements.

5. Prohibited Conduct

You may not use GrailVault to list, sell, or distribute counterfeit items. Engaging in fraudulent transactions, misrepresenting items, or manipulating reviews or trust scores is strictly prohibited. Harassment, threats, or abusive behavior toward other users will result in account suspension or termination. Any attempt to circumvent Platform fees, security measures, or authentication systems is prohibited.

All content, trademarks, logos, and intellectual property displayed on GrailVault are the property of JMKA LLC or their respective owners. You may not reproduce, distribute, or create derivative works from any content on the Platform without prior written consent. By posting content on GrailVault, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Platform.

8. Limitation of Liability

To the maximum extent permitted by law, JMKA LLC and GrailVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability for any claim arising from your use of GrailVault shall not exceed the fees you paid to us in the twelve months preceding the claim.

9. Disclaimer of Warranties

GrailVault is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. AI-powered authentication is provided as a tool to assist users and does not constitute a guarantee of item authenticity.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Any provisions of these Terms that by their nature should survive termination shall continue in effect.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be resolved in the appropriate courts of competent jurisdiction.
